Electronic Voting is Here! What you should know.

In September, the Governor signed Assembly Bill 2159, making electronic voting a reality for California community associations beginning January 1, 2025. 

AB 2159 allows electronic voting for director elections, governing document amendment votes, and votes to approve exclusive use of common area transfers. Votes regarding assessment increases requiring member approval must still be conducted via secret written ballot.

Membership approval is not required, however, associations must amend their election rules to allow for electronic voting. Additional notice requirements specific to electronic voting are included in this bill, as well as key deadlines and requirements for the Inspector of Elections who conducts the election. Members are allowed to opt-out and vote via written ballot.
